Summary of the Matter
This matter involves breach of an asset enhancement agreement entered into by the Swifthold Foundation and Fast Trading Group, a Qatari company owned by Sheikh Fahad bin Ahmed bin Mohamed bin Thani Al-Thani.
In July 2009, after entering into the agreement with Swifthold Foundation, Fast Trading Group accepted custody, through its affiliate Inprogramme S.A., from the Swifthold Foundation of a bond with a nominal value of $900 million. Upon receiving the bond, Fast Trading Group stopped communicating with the Swifthold Foundation and breached the agreement by failing to perform its terms.
Accordingly, the Swifthold Foundation sued Fast Trading Group in September 2010 in the U.K. High Court and obtained a $4 billion judgment against Fast Trading Group in October 2011. Subsequently, in November 2015, Sheikh Fahad bin Ahmed bin Mohamed bin Thani Al-Thani was personally added to the U.K. High Court judgment as a debtor.
In July 2018, the U.K. High Court judgment was refreshed and the U.K. High Court set the interested accrued on the on the judgment, resulting in a final judgment value of nearly $6 billion.
In January 2019, the Swifthold Foundation, through its Qatari legal counsel, filed a recognition action to have the U.K. High Court judgment recognized, and thereby enforceable, in Qatar. In July 2019, the Qatari Court ordered that the U.K. High Court judgment be recognized and begin enforcement against assets of the Sheikh.
